Regarding such, the operators of bustytitty.com restrict their actions to the transmission, storage, retrieval, hosting and/or formatting of the content, be it depictions of explicit or of simulated sexual activity, that is contributed by third-party users of the website. The areas of bustytitty.com on which user-furnished content is displayed are under the control of those users. The operators are thus exempt from compliance with Section 2257 records keeping and labeling obligations as per 28 C.F.R. §75.1(c)(4). In accordance with 18 U.S.C. § 2257(h)(2)(B)(v) and 47 U.S.C. § 230(c), the operator of the website may delete any images or videos if such are judged, at the operator’s sole discretion, to be indecent, obscene, defamatory, or inconsistent with the polices and terms of use of the website.
With regard to any visual depictions appearing on the website, for which the operators of the website may be considered “producers” or “secondary producers,” such depictions are excluded from compliance with the requirements of 18 U.S.C. §§2257, 2257A and 28 C.F.R. 75 because they do not portray actual sexually explicit conduct as specifically detailed in 18 U.S.C §2256 (2) (A)(i)-(iv); they do not portray depictions of the genitals or pubic area created after July 27, 2006; they do not portray simulated sexually explicit conduct created after the effective date of Title 18 U.S.C. §2257A; or, they were created prior to July 3, 1995.
